Terms of Service

These Terms of Service (“Terms”) govern your use of the TapPay mobile application, the send.usetappay.app website, and related services (the “Service”) provided by TapPay Technologies Ltd (“TapPay”, “we”, “our”, “us”), a company registered in Nigeria.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
- You must be at least 18 years old to use TapPay.
- You must provide accurate information during registration and keep it up to date.
- You must not use the Service for any purpose that violates applicable law, including anti-money laundering, counter-terrorism financing, or sanctions regulations.
2. Account and Wallet
2.1 Self-Custody
TapPay is a self-custody wallet. Your private key is generated on your device and stored exclusively in your device’s secure enclave. TapPay does not have access to your private key or recovery phrase. If you lose your recovery phrase, we cannot recover your funds.
2.2 Your Responsibility
You are solely responsible for:
- Safeguarding your recovery phrase and device access.
- Verifying recipient details before confirming any transaction.
- Maintaining the security of your device, including keeping your operating system up to date.
2.3 Account Security
You must immediately freeze your account using the in-app emergency freeze feature if you suspect unauthorised access. Contact us at support@usetappay.app if you believe your account has been compromised.
3. The Service
3.1 What TapPay Provides
- NFC tap-to-pay — Instant peer-to-peer payments by tapping phones together.
- Stablecoin transfers — Send and receive NGNm (Mento Nigerian Naira) and cUSD (Celo Dollar) on the Celo blockchain.
- Fiat on/off-ramp — Convert between Nigerian Naira (NGN) and NGNm via Flutterwave, and between foreign currencies and cUSD via Transak.
- International remittance — Receive money from abroad via the send.usetappay.app web page.
- Payment requests — Generate shareable payment links and QR codes.
3.2 Blockchain Transactions
Transactions on the Celo blockchain are irreversible once confirmed. TapPay cannot reverse, cancel, or modify confirmed blockchain transactions. You acknowledge that blockchain transactions are public and permanently recorded.
3.3 Stablecoins
NGNm and cUSD are stablecoins issued by the Mento Protocol, not by TapPay. While these tokens are designed to maintain their peg to the Nigerian Naira and US Dollar respectively, TapPay does not guarantee their value. The value of stablecoins may fluctuate.
4. KYC and Transaction Limits
To comply with Nigerian financial regulations, TapPay enforces Know Your Customer (KYC) requirements:
- Unverified accounts — Limited to small transactions. Withdrawals to bank accounts are not available.
- BVN-verified accounts — Higher transaction limits. Bank withdrawals and international transfers enabled.
- Fully verified accounts — Highest limits available.
Transaction limits are enforced server-side and cannot be bypassed. Current limits are displayed in Settings > Transaction Limits.
5. Fees
- Peer-to-peer transfers — Free. No fees for sending NGNm or cUSD to another TapPay user.
- NFC tap-to-pay — Free.
- Deposits via Flutterwave — Subject to Flutterwave’s fees.
- Withdrawals via Flutterwave — Subject to Flutterwave’s transfer fees.
- International transfers via Transak — Subject to Transak’s fees and exchange rates.
- On-chain currency conversion — Subject to Mento Protocol swap fees (currently 0.25%) and blockchain gas fees.
Fees are displayed before you confirm any transaction.
6. Prohibited Activities
You must not use TapPay to:
- Engage in money laundering, terrorist financing, or sanctions evasion.
- Purchase illegal goods or services.
- Engage in fraud, impersonation, or identity theft.
- Circumvent transaction limits or KYC requirements.
- Use automated systems, bots, or scripts to interact with the Service.
- Attempt to exploit, reverse-engineer, or compromise the Service’s security.
We monitor transactions for suspicious activity in compliance with CBN AML/CFT regulations. Violations may result in account freezing, reporting to authorities, and permanent suspension.
7. Account Suspension and Termination
We may suspend or terminate your account if:
- You violate these Terms or applicable law.
- Your account is flagged by our AML monitoring system.
- We are required to do so by a regulatory authority or court order.
- We detect fraudulent or suspicious activity on your account.
You may freeze your account at any time using the emergency freeze feature. Unfreezing requires OTP verification. You may delete your account at any time in Settings > Security Centre. Deletion is permanent and cannot be undone.
8. Third-Party Services
TapPay integrates with third-party services including Flutterwave, Transak, and the Mento Protocol. Your use of these services is subject to their respective terms and conditions. TapPay is not responsible for the availability, performance, or actions of third-party services.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- TapPay is not liable for losses caused by blockchain network failures, smart contract bugs in third-party protocols, or stablecoin de-pegging events.
- TapPay is not liable for losses caused by your failure to safeguard your recovery phrase or device.
- TapPay is not liable for losses caused by sending funds to an incorrect address that you provided.
- Our total liability for any claim arising from the Service is limited to the fees you paid to TapPay in the 12 months preceding the claim.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free service. We do not guarantee the value, stability, or availability of any stablecoin or blockchain network.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Lagos, Nigeria, except where prohibited by applicable consumer protection law.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
